The decision on environmental conditions for the implementation of a project is one of the key elements of carrying out an investment, and obtaining it, along with the provisions contained within, paves the way for securing a construction permit. Properly preparing an environmental decision is a challenging task, as it is acquired at an early stage of the investment project, yet it also sets the framework within which future business operations can be conducted.

The purpose of the environmental decision is to define the method of project implementation in such a way that it minimizes its negative impact on the environment, both during the construction phase and throughout its operation. The core of the process for issuing such a decision is the environmental impact assessment conducted by the authority managing the proceedings. An environmental impact assessment is required for projects that may have significant effects on the environment:
- Projects that will always significantly affect the environment (referred to as Group 1)
- Projects that may potentially significantly affect the environment (referred to as Group 2)
Post Implementation Analysis
In certain cases, a post implementation analysis may be required for a planned project. This type of study is similar in nature to an environmental impact report, but unlike the latter, it is conducted after the completion of the investment process. The goal is to determine whether the actual effectiveness of the solutions implemented to minimize environmental impact aligns with the assumptions made in the earlier stages of project planning.
The environmental impact assessment procedure varies depending on whether the planned project is classified as having a significant impact on the environment or as potentially having a significant impact on the environment. In practice, the process of preparing an appropriate application may include:
- For projects classified under Group 1 (always significantly impacting the environment): Determining the scope and level of detail required for the Environmental Impact Assessment (EIA) by the authority conducting the procedure, followed by the preparation of such a report.
- For projects classified under Group 2 (potentially significantly impacting the environment): Preparing a Project Information Sheet and, optionally (only if deemed necessary by the authority conducting the procedure), an Environmental Impact Assessment (EIA).
The preparation of a postimplementation analysis is comprehensive and includes, among other things:
- Checking whether the environmental objectives set out in the project have been achieved
- Conducting inspections to determine if the operation of the project complies with the accepted environmental protection standards and practices
- Assessing whether the monitoring procedures are adequate to ensure the fulfillment of environmental requirements in the future
- Identifying any implementation errors that could result in increased environmental impact
It is possible to authorize a representative from LEMITOR to represent the Client in administrative proceedings related to the preparation of the report, which accelerates the entire procedure and results in less inconvenience for the Client.
